New Zealand resumed Permanent Resident Visa applications

From 27 November 2020, Immigration New Zealand has resumed processing of Permanent Resident Visa applications, including where the principal applicant is currently offshore. Certain changes have been made by the New Zealand Government in keeping with the Epidemic Management Notice that has been in effect since April 2, 2020.

This is very welcome news for many resident visa holders who were eligible for their PRV but were caught offshore and were previously unable to have their PRV processed.

Every country is different. Each has its own laws, rules and ways of doing things. The people, even if they speak the same language as you, have their own accent and their own everyday language.
Hearing stories from other migrants will help you to make sense of your experiences, and as you get more involved in New Zealand life and the community, you will be able to tell your own stories.

Residence applications whereby the person are already in New Zealand are going to be given priority over those applications during which the applicant is overseas. Among the New Zealand temporary visa applications, priority is to lean to applications for temporary visa candidates that are already in New Zealand and important staff that are required for supporting the govt response to COVID-19. INZ encourages applicants to use on-line for eligible visas as paper applications can take a extended time because of the reduction of staff in their onshore offices.

On a temporary basis, the Government of New Zealand has decided to relax visa conditions for a short period of time in order to allow international students and temporary migrant workers to assist with essential services during COVID-19.

Canada Dual Intent Visa for Spousal Sponsorship Update

A  dual  intent  is present  when a foreign  national  who has applied  for permanent  residence  in Canada  or who could apply  for permanent  residence  in Canada  also  requests  to enter  Canada  for a temporary  period

It  is possible  to apply  for spousal  sponsorship  at the same time  as a visitor  visa  thanks  to the double  visa  concept. Canada  clarifies  dual  intent  for foreign  marriage  sponsorship  applicants  It  is possible  to apply  for spousal sponsorship  at the same time  as applying  for a visitor  visa  thanks  to the concept  of dual  use

Some  couples  who apply  for the sponsorship  of their spouse  or civil  law  partner  want  to apply  for a Temporary  Resident  Visa  TRV first  and then travel  to Canada  to apply  for national  sponsorship

Another option is to apply for both. Although immigration  officials  must  ensure  that temporary  visa  applicants  leave  at the end  of their authorized  period  of stay  it is possible  to apply  for permanent  residence  as a temporary  resident. In  other words  applying  for temporary  residence  in any form  does not prevent  you from applying  for permanent  residence

The official  must  distinguish  between a bona fide temporary  resident  applicant  who intends  to fulfill  his obligations  as a temporary  resident i.e. leave  at the end  of the authorized  stay  R179 and an applicant  who does not intend  to leave  Canada  at the end  of the authorized  stay  if their application  for permanent  residence  is rejected. To assess  the intentions  of the applicant  it is necessary  to study  the individual  circumstances  of the applicant  for temporary  residence  Refusals  from unscrupulous  temporary  residents  can only be challenged  if the refusal  is based  on information  relating  to a specific  matter  addressed  to the official.

Study in Australia - New Laws of Australian Student Visa

Formerly in the year, the Department of Immigration and Citizenship (DIAC) made the below mentioned amendments:

• Post-study visa plans were introduced by DIAC, where graduates of bachelor, masters and PhDs shall be permitted to work in Australia for four years after graduation.

• Instead of just IELTS, Australian student visa applicants are now permitted to put forward results from the examination of English as a Foreign Language internet-based test (TOEFL iBT), the Pearson Test of English (PTE) Academic and the Cambridge English: Advanced (CAE) test.

• DIAC allowed prepaid home stay fees to be incorporated in the financial requirements assessment.

• Extension was granted to the PhD students staying in Australia until the completion of the research work and it's marking.

• The pre-visa assessment (PVA) policy is now discontinued for student visa applicants from Assessment Levels 3 and 4 (enrollment in a bachelor degree or higher qualification).

• The evaluation levels have been lowered significantly, for applicants from a number of countries.

These changes will have the following effect:

Visa costs
The visa application charge of AUD$535 now is applicable to most visa applications (previously AUD$565) and the same is non- refundable. No fee is applicable for students who are sponsored under Common Wealth Programs, secondary school exchange students or students affected by the closure of their education provider. To know if you come in this category, visit an Australian Visa agent.

Visa processing for higher education students
Student visa applicants who file their applications with a Confirmation of Enrollment (CoE) from a participating university in Australia at bachelor, masters or doctoral degree level will be assessed as though they are a lower migration risk (similar to the current Assessment Level 1), despite of their country of origin.

Permission to work
Students who were given Student Visa on or after 26 April 2008 have automatic work rights - included in the $535 visa application charge. If, though, you were granted a student visa before this date and if you wish to apply for work rights, then this will attract a fee of $75.

Employment restrictions
Before March 2012, global students were allowed to work up to utmost 20 hours per week. The same has been altered to a more flexible 40 hours every 15 days, wherein a student can work 15 hours in a week and 25 hours the coming week, rather than following 20 hours per week stringently. Students may work unlimited hours during semester breaks. Work limits are not applicable to students carrying out a masters or doctoral degree.
